This website is operated by Podtas. Throughout the website, the terms “Podtas,” “we,” “us,” and “our” refer to Podtas.

Podtas provides this website, online-store functionality, customization tools, products, information, and related services subject to your acceptance of these Terms of Service.

These Terms apply to all website visitors, account holders, customers, purchasers, and persons who upload or submit content through Podtas.

By visiting the website, using a customization tool, uploading an image, selecting a required confirmation checkbox, adding a product to your cart, or completing a purchase, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must not use the customization services, upload content, or place an order.

Our store is hosted through Shopify, which provides the ecommerce platform used to display products and process transactions.

By using the website or placing an order, you represent that you are at least the age of majority in your place of residence or that you are using the website with the authorization and supervision of a parent or legal guardian.

You may not use the website, products, customization tools, or services for an illegal, fraudulent, deceptive, or unauthorized purpose.

You may not violate applicable laws or the rights of another person or organization while using Podtas.

You must not upload, transmit, or introduce viruses, malicious code, automated attacks, or other technology intended to disrupt, damage, monitor, or interfere with the website or its users.

We may restrict or terminate access to the website or customization services when we reasonably believe these Terms have been violated.

Podtas offers standard and personalized products, including apparel, mugs, metal signs, floor mats, and other products displayed on the website.

Available customization features vary by product. When a product page provides only an image-upload option, the customer must upload the complete image or design they want printed. Separate custom text cannot be added unless that option is expressly shown on the applicable product page.

Before completing an order, you are responsible for reviewing:

• Product type and quantity.
• Size, color, material, style, and orientation.
• The selected product variant.
• Every uploaded photograph, logo, artwork, or design.
• Image cropping, placement, scale, and preview.
• Shipping address and contact information.

Once production begins, personalized products generally cannot be changed or canceled because they are made specifically for the customer.

Unless Podtas expressly agrees otherwise in a separate written agreement, personalized products ordered through Podtas are sold exclusively for the purchaser’s personal, private, and non-commercial use or for use as a personal gift.

Personalized products may not be:

• Resold or offered for resale.
• Listed on Amazon, Etsy, eBay, Shopify, TikTok Shop, social media, or another marketplace or retail channel.
• Used as business merchandise, employee merchandise, uniforms, branded workwear, or inventory.
• Used in paid advertising, sponsored content, marketing campaigns, or commercial product photography.
• Distributed as promotional merchandise, branded giveaways, prizes, samples, or event merchandise.
• Used for fundraising, sponsorship, organizational promotion, or revenue-generating activities.
• Licensed, sublicensed, wholesaled, commercially distributed, or otherwise commercially exploited.
• Used to generate revenue, customer acquisition, commercial publicity, or another business benefit.

Podtas does not grant customers any copyright, trademark, merchandise, resale, advertising, promotional, endorsement, distribution, or sublicensing rights relating to uploaded content.

Customers select and submit the photographs, artwork, logos, graphics, designs, likenesses, and other images they want reproduced on personalized products.

Podtas provides customer-directed print-on-demand production and fulfillment services. Podtas does not create, choose, sponsor, endorse, license, or independently verify ownership of every customer-uploaded image.

By uploading content or placing an order, you represent and warrant that:

• You created and legally own the content or have express permission to reproduce and print it.
• You have obtained all required licenses, authorizations, consents, and releases.
• The content does not infringe copyright, trademark, trade dress, privacy, publicity, contractual, licensing, or other third-party rights.
• You have any permission required from identifiable people appearing in the image.
• The content does not falsely suggest sponsorship, endorsement, licensing, approval, or affiliation.
• The content and finished product will be used in accordance with these Terms.

Downloading, purchasing, screenshotting, saving, receiving, editing, or finding an image online does not automatically give you permission to reproduce or print it.

Giving credit, adding a disclaimer, changing colors, cropping an image, removing a watermark, or combining an image with other elements does not automatically establish ownership or authorization.

Additional requirements are contained in the Customer Upload and Intellectual Property Policy , which is incorporated into these Terms.

Unless you have express authorization from every applicable rights owner, you must not upload or submit content containing:

• Brand names, company names, trademarks, service marks, logos, slogans, trade dress, packaging, or branded product designs.
• Copyrighted artwork, illustrations, photographs, graphics, patterns, designs, music artwork, or book artwork.
• Movie, television, animation, comic, book, toy, music, or video-game characters and imagery.
• Celebrity, athlete, musician, performer, influencer, public-figure, or private-person names, images, signatures, or likenesses.
• Sports team, league, tournament, university, school, club, association, event, or organization names and marks.
• Professional photographs, stock images, website images, social-media images, or screenshots without sufficient permission.
• Content marked “personal use only,” “editorial use only,” “non-commercial use,” “fan art,” “not for resale,” or subject to restrictions that do not permit the requested printing.

You must also not upload content that:

• Is illegal, fraudulent, deceptive, or defamatory.
• Is threatening, harassing, hateful, or abusive.
• Exploits, sexualizes, or harms minors.
• Contains unlawfully disclosed private information.
• Promotes terrorism, serious unlawful violence, or criminal activity.
• Violates privacy, publicity, confidentiality, contractual, licensing, or other legal rights.
• Falsely suggests sponsorship, licensing, approval, endorsement, partnership, or affiliation.
• Creates material legal, safety, payment-processing, production, platform, or reputational risk.

You retain any ownership rights that you legally hold in the original content you upload. Podtas does not claim ownership of customer-uploaded images.

By uploading content, you grant Podtas and its production, technology, hosting, payment, customer-service, shipping, and fulfillment providers a limited, non-exclusive, royalty-free permission to:

• Receive, store, access, and process the uploaded file.
• Resize, crop, position, format, convert, or adjust the file for production.
• Create previews and production-ready files.
• Reproduce and print the content on the ordered product.
• Manufacture, package, fulfill, ship, replace, and support the order.
• Preserve relevant records when reasonably necessary to resolve a complaint, dispute, chargeback, investigation, or legal request.

This permission is limited to processing and supporting the customer’s order. It does not transfer ownership of the uploaded content to Podtas.

Podtas will not use a customer-uploaded image in unrelated public advertising without separate permission.

Podtas reserves the right, but is not obligated, to review customer-uploaded content.

Podtas may, at its discretion:

• Reject, block, or remove an uploaded image.
• Request proof of ownership, permission, consent, licensing, or authorization.
• Pause production while content is reviewed.
• Request that the customer provide a replacement image.
• Refuse to manufacture or fulfill an affected product.
• Cancel and refund an affected order.
• Restrict access to customization services for repeated or serious violations.

Podtas may take these actions when content may violate applicable law, third-party rights, platform requirements, payment-provider rules, production-partner rules, or Podtas policies.

Acceptance, previewing, processing, production, fulfillment, or delivery of an order does not mean that Podtas has confirmed that the uploaded content is authorized, non-infringing, or legally permitted.

Product images, digital previews, mockups, and customization previews are visual guides and may not represent the finished product with absolute precision.

The final product may vary slightly in color, brightness, scale, alignment, image placement, cropping, print texture, or appearance because of:

• Screen and device display settings.
• Product size, shape, material, and orientation.
• Image resolution and aspect ratio.
• Manufacturing and printing processes.
• Normal production tolerances.

Minor variations that do not materially affect the intended design or ordinary use of the product are not considered defects.

Low-resolution, dark, blurred, cropped, compressed, or incorrectly proportioned customer images may produce lower-quality results. Customers are responsible for reviewing the uploaded file and available preview before ordering.

Product prices, discounts, promotions, shipping charges, and availability may change without prior notice.

The price displayed during checkout, together with applicable shipping charges and taxes, is the price charged for the order unless a clear pricing or technical error occurred.

Discounts and promotional offers may be subject to eligibility, quantity, time, product, geographic, and other restrictions. Unless expressly stated otherwise, discounts cannot be combined.

You agree to provide current, complete, and accurate billing, payment, contact, and account information.

You represent that you are authorized to use the payment method submitted with the order.

Applicable sales taxes, use taxes, customs charges, import charges, or similar governmental fees may be collected or remain the customer’s responsibility where required by law.

An order confirmation acknowledges that we received your order. It does not require Podtas to accept or fulfill the order when there is a payment, inventory, technical, policy, legal, fraud, or production issue.

Podtas may limit, refuse, hold, or cancel an order when reasonably necessary, including orders that:

• Contain suspected unauthorized or prohibited content.
• Appear fraudulent, abusive, or unauthorized.
• Contain inaccurate billing or shipping information.
• Result from an obvious pricing or technical error.
• Exceed reasonable quantity or promotional limits.
• Appear to be placed by an unauthorized reseller.
• Cannot be safely or reliably produced.

When reasonably possible, we may contact you using the email address or telephone number provided with the order.

When an order is canceled before fulfillment, an applicable refund will ordinarily be issued to the original payment method, subject to payment-provider processing times.

Personalized products require production time before shipment. Processing times may vary by product, uploaded image, order volume, production availability, and quality review.

Delivery dates and transit times displayed on the website are estimates and are not guaranteed unless Podtas expressly states otherwise in writing.

Delays may occur because of carriers, weather, address errors, service disruptions, holidays, customs, emergencies, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect, incomplete, refused, or undeliverable address may be charged to the customer where permitted.

Additional shipping requirements are contained in our Shipping Policy.

Because personalized products are made specifically according to customer instructions, they generally cannot be returned, exchanged, or refunded for reasons such as:

• Change of mind.
• Ordering the wrong size, color, style, or quantity.
• Providing an incorrect or low-quality image.
• Customer-approved cropping, placement, or personalization.
• Providing an incorrect delivery address.
• Personal preference after the product has been produced.

Podtas may provide replacement support when an item arrives damaged, defective, materially different from the confirmed personalization, or otherwise qualifies under the applicable policy.

Customers must report eligible problems within the period stated in the Refund and Replacement Policy and provide the requested order information, photographs, videos, measurements, or other evidence.

Nothing in this section limits rights that cannot legally be excluded under applicable consumer protection law.

We make reasonable efforts to provide accurate product descriptions, prices, promotions, shipping information, and website content.

The website may occasionally contain typographical errors, incorrect prices, outdated information, technical problems, or omissions.

To the extent permitted by law, we may correct errors, update information, change product descriptions, modify prices, or cancel an affected order.

Historical information may be provided for reference and may no longer be current.

When you create an account or provide information during checkout, you agree to provide accurate and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account, except where unauthorized activity results from circumstances for which you are not legally responsible.

You must promptly notify Podtas if you reasonably believe that your account, email address, payment information, or order details have been used without authorization.

Reviews, comments, suggestions, feedback, and other non-order submissions must be truthful and must not violate another person’s rights.

You must not submit content that:

• Is knowingly false, misleading, or deceptive.
• Contains unlawful, threatening, or defamatory material.
• Contains private information without permission.
• Infringes intellectual property or other legal rights.
• Contains viruses, malicious code, or harmful links.
• Impersonates another person or misrepresents its origin.

By voluntarily submitting feedback or a review, you grant Podtas a non-exclusive permission to display, reproduce, format, and use that submission in connection with operating and promoting Podtas, subject to applicable privacy law.

This feedback license does not apply to private customer-uploaded personalization images unless separate permission is obtained.

Podtas may moderate or remove reviews and submissions that violate these Terms, applicable law, or platform requirements.

The website may use or link to third-party services, including Shopify, payment processors, personalization applications, review tools, shipping providers, analytics providers, and social platforms.

Third-party services may be governed by their own terms and privacy policies. Podtas does not control all third-party systems, websites, or content.

To the extent permitted by law, Podtas is not responsible for losses caused solely by an independent third-party service that is outside Podtas’s reasonable control.

You should review applicable third-party terms before using an optional third-party service or following an external link.

Personal information submitted through Podtas is handled in accordance with our Privacy Policy.

By placing an order or contacting Podtas, you consent to receive transactional communications reasonably necessary to process, fulfill, deliver, support, or resolve issues relating to your order.

Marketing communications will be sent only as permitted by applicable law, and available unsubscribe options will be honored.

You must not use the website or services to:

• Violate applicable law or another person’s rights.
• Submit false, fraudulent, or misleading information.
• Conduct payment fraud or unauthorized transactions.
• Upload unauthorized or prohibited content.
• Harass, threaten, abuse, or unlawfully discriminate.

Podtas may suspend or terminate access for prohibited activity.

Podtas does not guarantee that the website, customization tools, or third-party services will always be uninterrupted, error-free, or available.

Except for express commitments stated in these Terms, an applicable product policy, or mandatory law, the website and online services are provided on an “as available” basis.

Podtas does not provide legal advice concerning copyright, trademark, privacy, publicity rights, licensing, fair use, or the public-domain status of customer-uploaded content.

Customers must make their own rights and permission determinations before uploading an image.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, Podtas and its service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the website or purchase of a product, including lost profits, lost business, lost data, or loss of opportunity.

To the fullest extent permitted by applicable law, Podtas is not responsible for claims resulting from:

• A customer’s unauthorized uploaded content.
• A customer’s inaccurate representation of ownership.
• An insufficient or restricted image license.
• Failure to obtain required consent or authorization.
• Violation of another party’s legal rights.
• Prohibited commercial use of a personalized product.
• Incorrect customer-provided order or delivery information.

Where liability cannot be excluded, Podtas’s aggregate liability relating to an affected order will, to the fullest extent permitted by law, not exceed the amount paid to Podtas for the affected product.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, you are responsible for claims, disputes, losses, liabilities, and expenses arising from:

• Content you upload or ask Podtas to reproduce.
• Your lack of required ownership or authorization.
• Your infringement of copyright, trademark, trade dress, privacy, publicity, contractual, licensing, or other rights.
• Your unauthorized resale, advertising, promotion, distribution, or commercial use of a personalized product.
• Your violation of a personal-use, editorial-use, or non-commercial license.
• Your violation of these Terms or another Podtas policy.
• Your fraudulent, unlawful, or misleading activity.

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Podtas, its owners, affiliates, employees, contractors, service providers, technology providers, payment processors, production partners, shipping providers, and fulfillment partners from related third-party claims, demands, proceedings, liabilities, losses, damages, judgments, settlements, costs, and reasonable expenses.

Podtas will provide reasonable notice of a covered claim when practicable. You agree to reasonably cooperate in responding to or resolving that claim.

Rights owners or authorized representatives who believe that content submitted to or displayed by Podtas violates their intellectual property, privacy, or publicity rights may contact:

A complaint should include:

• The complainant’s full legal name and contact information.
• Identification of the copyrighted work, trademark, publicity right, or other protected right.
• Identification or URL of the allegedly infringing content or product.
• An explanation of ownership or authority to act for the rights owner.
• A good-faith statement that the disputed use is not authorized by the rights owner, its agent, or applicable law.
• Supporting registration, ownership, or authorization documents when available.
• A physical or electronic signature.

Podtas may remove content, suspend production, cancel an order, request additional information, preserve relevant records, or take other appropriate action after receiving a sufficiently detailed complaint.

Podtas is not affiliated with, sponsored by, endorsed by, licensed by, or officially connected with any third-party brand, company, celebrity, athlete, sports organization, university, school, entertainment property, or other rights owner unless expressly stated by Podtas in writing.

Third-party names, trademarks, logos, photographs, artwork, characters, and other protected materials remain the property of their respective owners.

This statement does not authorize customers to upload, reproduce, print, sell, or otherwise use third-party intellectual property.

These Terms remain effective while you access or use Podtas.

You may stop using the website at any time. Podtas may suspend or terminate access to the website or customization services when we reasonably believe that:

• These Terms or another Podtas policy has been violated.
• Fraudulent or unauthorized activity has occurred.
• Another person’s legal rights are at risk.
• Continued access creates legal, security, or operational risk.

Obligations that by their nature should survive termination will remain in effect, including payment obligations, uploaded-content warranties, indemnification, liability limitations, and dispute provisions.

These Terms and transactions with Podtas are governed by applicable law, without giving effect to conflict-of-law rules that would require application of another jurisdiction’s law.

Nothing in these Terms limits any mandatory consumer protection rights that apply in the customer’s place of residence.

Before filing a formal claim, you and Podtas agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and providing sufficient information about the issue.

Any unresolved claim may be brought before a court or other tribunal having lawful jurisdiction over the dispute.

If any part of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent legally permitted or severed when necessary.

The remaining provisions will continue in effect.

A failure or delay by Podtas to enforce a provision does not waive the right to enforce that provision or another provision later.

These Terms, together with the policies linked within them, constitute the agreement between you and Podtas regarding use of the website, customer-submitted content, personalized products, and purchases through Podtas.

If a general term conflicts with a product-specific or issue-specific policy, the more specific provision will control for that issue, subject to applicable law.

The version available when an order is placed will generally apply to that order unless applicable law requires otherwise.
