This Customer Upload and Intellectual Property Policy applies to every image, photograph, artwork, graphic, logo, design, likeness, and other item of content uploaded or submitted to Podtas.

By uploading content, using a customization tool, selecting a required acknowledgment, adding a customized product to your cart, or completing a purchase, you acknowledge that you have read, understood, and agreed to this policy.

If you do not agree to this policy, do not upload an image or place a customized-product order.

Podtas currently provides image-upload customization. Customers must upload the complete image or design they want printed.

Customers cannot add separate custom text unless an applicable product page expressly displays a separate text-customization option.

Customers are responsible for reviewing the uploaded image, selected product, size, orientation, cropping, placement, and available preview before placing an order.

Image quality responsibility: Please upload a clear, high-resolution JPG or PNG image. Blurry, pixelated, dark, overexposed, heavily compressed, distorted, or improperly cropped images may affect the appearance of the finished product.

Products affected by poor customer-submitted image quality are not eligible for return, refund, or free replacement unless the finished product contains a material production error caused by Podtas or differs materially from the confirmed customization.

You may upload content only when one of the following applies:

• You personally created the content and legally own it.
• You have received express permission from the applicable rights owner to reproduce and print it.
• You hold a valid license that specifically permits reproduction on the selected physical product.
• The content is lawfully in the public domain and may be used for the requested purpose.

Permission to view, possess, download, share, repost, display, or privately use an image does not necessarily include permission to reproduce it on a physical product.

When an identifiable person appears in the uploaded image, you are responsible for obtaining any consent, model release, privacy authorization, or publicity-rights permission required for the requested use.

Unless Podtas expressly authorizes another use in a separate written agreement, customized products ordered through Podtas are sold exclusively for the purchaser’s personal, private, and non-commercial use or as personal gifts.

Customized products may not be:

• Resold or offered for resale.
• Listed on Amazon, Etsy, eBay, Shopify, TikTok Shop, social media, or another marketplace or retail channel.
• Used as company merchandise, business merchandise, employee merchandise, uniforms, branded workwear, or commercial inventory.
• Used in advertisements, marketing campaigns, sponsored content, or commercial product photography.
• Distributed as promotional products, branded giveaways, samples, prizes, or event merchandise.
• Used for fundraising, sponsorship, organizational promotion, political campaigning, or revenue-generating activities.
• Licensed, sublicensed, wholesaled, commercially distributed, or otherwise commercially exploited.
• Used to generate revenue, customer acquisition, commercial publicity, business advantage, or another commercial benefit.

Owning an uploaded image does not remove this contractual personal-use restriction.

Podtas does not grant any merchandise, resale, advertising, promotional, endorsement, distribution, or sublicensing rights.

Unless you have express authorization from every applicable rights owner, you must not upload content containing:

• Brand names, company names, trademarks, service marks, logos, slogans, trade dress, packaging, or branded product designs.
• Copyrighted artwork, illustrations, photographs, graphics, designs, patterns, album artwork, or book artwork.
• Movie, television, animation, comic, book, toy, music, or video-game characters and imagery.
• Celebrity, athlete, musician, performer, influencer, public-figure, or private-person names, images, signatures, voices, or likenesses.
• Sports team, league, tournament, university, school, club, association, event, or organization names and marks.
• Professional photographs, stock images, website images, social-media images, or screenshots without sufficient printing permission.
• Content subject to a personal-use, editorial-use, non-commercial-use, fan-art, or not-for-merchandise restriction that does not permit the requested reproduction.

You must not upload content that is:

• Illegal, fraudulent, deceptive, or defamatory.
• Threatening, harassing, hateful, discriminatory, or abusive.
• Obscene, sexually exploitative, or harmful to minors.
• Invasive of another person’s privacy or publicity rights.
• Unlawfully disclosing personal or confidential information.
• Intended to falsely suggest sponsorship, licensing, approval, endorsement, partnership, or affiliation.
• Prohibited by applicable law, platform rules, payment-provider rules, production-partner rules, carrier requirements, or other Podtas policies.

By uploading content or placing a customized-product order, you represent and warrant that:

• You have the legal right to submit and print the content.
• You own the content or have obtained all required permissions, licenses, consents, releases, and authorizations.
• Reproduction and printing will not infringe or violate another party’s copyright, trademark, trade dress, privacy, publicity, contractual, licensing, or other legal rights.
• Your submission does not falsely suggest sponsorship, affiliation, endorsement, approval, or licensing.
• The finished product will be used only for personal, private, and non-commercial purposes.
• Information and authorization documents provided to Podtas are accurate, current, and complete.

Podtas provides customer-directed printing, production, fulfillment, shipping, and order-support services.

Podtas does not create, select, sponsor, endorse, license, or independently verify ownership of every customer-uploaded image.

Podtas does not provide legal advice and does not determine whether a customer’s proposed use qualifies as fair use, public domain use, licensed use, or another legally permitted use.

Customers must make their own rights and permission determinations before uploading content.

Acceptance, previewing, processing, production, fulfillment, or delivery of an order does not constitute confirmation by Podtas that the uploaded content is authorized, non-infringing, or legally permitted.

Customers retain any ownership rights they legally hold in their uploaded content. Podtas does not claim ownership of customer-uploaded images.

By uploading content, you grant Podtas and its production, technology, hosting, payment, customer-service, shipping, and fulfillment providers a limited, non-exclusive, royalty-free permission to:

• Receive, store, access, and process the uploaded file.
• Resize, crop, position, format, convert, or make production adjustments to the file.
• Create product previews and production-ready files.
• Reproduce and print the content on the ordered product.
• Manufacture, package, fulfill, ship, replace, or otherwise support the order.
• Preserve relevant records when reasonably necessary to resolve a complaint, dispute, chargeback, investigation, or legal request.

This permission is limited to processing and supporting the customer’s order and does not transfer ownership of the uploaded content to Podtas.

Podtas will not use a private customer-uploaded image in unrelated public advertising without separate permission.

Podtas reserves the right, but is not obligated, to review customer-uploaded content.

Podtas may, at its discretion:

• Reject, block, or remove an uploaded image.
• Request proof of ownership, permission, licensing, consent, or authorization.
• Pause production while the content is reviewed.
• Ask the customer to submit a replacement image.
• Refuse to manufacture or fulfill an affected product.
• Cancel and refund an affected order.
• Restrict access to customization services for repeated or serious violations.

Podtas may take these actions when content may violate applicable law, third-party rights, platform requirements, payment-provider requirements, production-partner requirements, or Podtas policies.

Podtas may act without making a final legal determination regarding ownership, authorization, or infringement.

You agree to promptly provide reasonable documentation and cooperate with Podtas regarding complaints, claims, takedown requests, payment disputes, platform inquiries, investigations, or legal notices involving your uploaded content.

To the fullest extent permitted by applicable law, you accept responsibility for claims arising from:

• Your uploaded or submitted content.
• Your lack of ownership, permission, or authorization.
• Your violation of copyright, trademark, privacy, publicity, licensing, contractual, or other third-party rights.
• Your unauthorized resale, advertising, distribution, promotion, or other commercial use of a customized product.
• Your breach of this policy or another Podtas policy.

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Podtas, its owners, affiliates, employees, contractors, service providers, production partners, shipping providers, and fulfillment partners from related third-party claims, demands, proceedings, liabilities, losses, damages, judgments, settlements, costs, and reasonable expenses.

Nothing in this section excludes or limits responsibility that cannot lawfully be excluded or limited.

Podtas is not affiliated with, sponsored by, endorsed by, licensed by, or officially connected with any third-party brand, company, celebrity, athlete, sports organization, university, school, entertainment property, or other rights owner unless expressly stated by Podtas in writing.

Third-party names, trademarks, logos, photographs, artwork, characters, and other protected materials remain the property of their respective owners.

This statement does not authorize customers to upload, reproduce, print, sell, or otherwise use third-party intellectual property.

Rights owners or authorized representatives who believe that content submitted to or displayed by Podtas violates their intellectual property, privacy, or publicity rights may contact:

• Your full legal name and contact information.
• Identification of the copyright, trademark, publicity right, or other protected right.
• Identification or URL of the allegedly infringing content or product.
• An explanation of your ownership or authority to act for the rights owner.
• A good-faith statement that the disputed use is not authorized by the rights owner, its agent, or applicable law.
• Supporting registration, ownership, or authorization documents when available.
• Your physical or electronic signature.

Podtas may remove content, suspend production, cancel an order, preserve relevant records, request additional information, or take other appropriate action after receiving a sufficiently detailed complaint.

This policy forms part of and is incorporated into the Podtas Terms of Service.

Customer orders are also subject to the applicable Refund and Replacement Policy, Shipping Policy, Privacy Policy, product-page terms, and checkout disclosures.

If a general provision conflicts with a product-specific or issue-specific policy, the more specific provision will control for that issue, subject to applicable law.

Podtas may update this policy to reflect changes to its services, production processes, platform requirements, legal requirements, or business practices.

Updated terms become effective when posted on this page unless a different effective date is stated.

The version displayed when an order is placed will generally apply to that order unless applicable law requires otherwise.

Continued use of Podtas customization services after an updated policy becomes effective constitutes acceptance of the updated policy.
