Customer Upload and Intellectual Property Policy

Customers are solely responsible for all images, photographs, artwork, designs, logos, text, names, likenesses, and other content they upload or submit to Podtas.

Podtas provides customer-directed print-on-demand production and fulfillment services only. Podtas does not create, select, sponsor, endorse, license, or independently verify ownership of customer-uploaded content.

By submitting content, the customer represents and warrants that the customer owns the content or has obtained all rights, permissions, licenses, releases, and authorizations required to use, reproduce, resize, crop, adjust, print, manufacture, and deliver it as part of the customized product.

Purchasing, downloading, saving, or possessing an image does not necessarily give the customer the legal right to reproduce, distribute, or commercially print that image.

Customers must not upload or submit content that:

• Uses an unauthorized brand name, logo, trademark, trade dress, slogan, packaging design, or other brand identifier.
• Contains copyrighted artwork, illustrations, photographs, graphics, music artwork, or other protected creative material without permission.
• Contains movie, television, animation, comic, book, game, or entertainment characters without authorization.
• Uses the name, photograph, image, likeness, signature, voice, or other identifying characteristics of another person without any required permission.
• Uses professional sports league, team, university, organization, club, or event names and logos without authorization.
• Falsely suggests sponsorship, endorsement, licensing, approval, partnership, or affiliation with another person, company, organization, or rights owner.
• Is unlawful, threatening, defamatory, fraudulent, hateful, exploitative, abusive, or otherwise prohibited by applicable law or Podtas policies.

Podtas acts as an independent provider of customer-directed printing, production, and order-fulfillment services.

Podtas is not affiliated with, sponsored by, endorsed by, licensed by, or officially connected with any third-party brand, company, celebrity, athlete, sports organization, university, entertainment property, or other rights owner unless expressly confirmed by Podtas in writing.

All third-party names, logos, trademarks, artwork, characters, and other protected materials remain the property of their respective owners.

This statement does not give customers permission to reproduce third-party intellectual property.

Customers retain any ownership rights they legally hold in their uploaded content. Podtas does not claim ownership of customer-uploaded images.

By uploading content, the customer grants Podtas and its production, technology, payment, customer-service, shipping, and fulfillment partners a limited, non-exclusive license to store, access, reproduce, resize, crop, adjust, process, transmit, and print the content solely as reasonably necessary to:

• Review and process the order.
• Manufacture the customized product.
• Provide previews or production files.
• Fulfill and deliver the order.
• Provide customer support.
• Investigate or resolve an order-related complaint.

Podtas reserves the right, but is not obligated, to review customer-uploaded content.

Podtas may, at its discretion:

• Reject or remove an uploaded image.
• Request proof of ownership, consent, or authorization.
• Pause production while authorization is reviewed.
• Request that the customer provide a replacement image.
• Refuse to manufacture or fulfill the customized product.
• Cancel and refund the affected order.

These actions may be taken when Podtas reasonably believes the content could violate applicable law, intellectual property rights, publicity or privacy rights, platform requirements, payment-provider requirements, or Podtas policies.

Acceptance, processing, previewing, production, or fulfillment of an order does not constitute a legal determination or confirmation by Podtas that the uploaded content is authorized, non-infringing, or legally permitted.

Customers agree to provide reasonable documentation showing ownership, permission, consent, or authorization when requested.

Customers must promptly cooperate with Podtas regarding any complaint, claim, takedown request, investigation, legal notice, payment dispute, or platform inquiry involving their uploaded content.

Podtas may pause production, remove content, cancel an order, preserve relevant records, or provide information when reasonably required by applicable law, a valid court order, lawful legal process, or applicable platform policy.

To the fullest extent permitted by applicable law, the customer assumes responsibility for claims arising from the content the customer uploads or submits.

The customer agrees to defend, indemnify, and hold harmless Podtas, its owners, employees, contractors, service providers, production partners, and fulfillment partners from third-party claims, demands, proceedings, losses, liabilities, damages, judgments, settlements, costs, and reasonable expenses arising from:

• The customer’s uploaded content.
• The customer’s unauthorized use of third-party content.
• The customer’s breach of this policy.
• An allegation that the customer’s content infringes or violates another party’s legal rights.

Rights owners or authorized representatives who believe that content submitted to or displayed by Podtas violates their intellectual property rights may contact:

• Your full legal name and contact information.
• Identification of the copyrighted work, trademark, or other protected right.
• Identification or URL of the allegedly infringing content or product.
• A statement explaining your ownership or authority to act for the rights owner.
• A good-faith statement that the disputed use is not authorized by the rights owner, its agent, or applicable law.
• Registration details or other supporting documentation when available.
• Your physical or electronic signature.

Podtas may remove content, stop production, cancel an order, request additional information, or take other appropriate action after receiving a sufficiently detailed complaint.

By uploading an image, selecting the required confirmation checkbox, submitting an order, or completing a purchase, the customer acknowledges that the customer has read, understood, and agreed to this Customer Upload and Intellectual Property Policy.

If the customer does not own the image or does not have permission to reproduce and print it, the customer must not upload the image or place the order.
